CHBA BC PROMPT PAYMENT DRAFT LEGISLATION

On November 27, Bill 20 - 2025 (Construction Prompt Payment Act) received Royal Assent.

This legislation introduces statutory timelines for invoicing, payment, and dispute resolution (through adjudication), and will take effect by regulation.

We have already been informed that the effective date will be delayed intentionally to mitigate immediate impacts to the building industry. Prior to the effective date, the Province will also be required to consult on and draft regulation enabled by the Act.

Next steps:

  • The Province must draft regulations and have confirmed we will be a part of the consultation process.
  • Once regulation has been drafted, we'll have a better idea of when the effective date is anticipated to be (for other provinces, there has been up to a 2-3 year delay).
  • CHBA BC will continue to advocate for a delay in the effective date and phased implementation with application to the public sector first.
